Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the xCrypt service provided by SkyL4rk (Pty) Ltd, based in Ballito, KwaZulu-Natal, South Africa. By using xCrypt, you agree to these terms. If you do not agree, please discontinue use of the Service.

1. Who We Are

SkyL4rk (Pty) Ltd develops digital platforms and backend services. xCrypt is our license and API key management platform for SaaS products, B2B clients, and integration tools like PayedNow.

2. Your Account

You are responsible for all activity under your API credentials, license keys, and client accounts. Keep your credentials secure and notify us immediately of any breach or misuse.

3. API Keys & License Terms

API keys grant authenticated access to the platform. License keys define your or your sub-client’s entitlement level. Sharing, reselling, or modifying issued credentials is prohibited unless explicitly authorized.

4. Subscription Plans & Tokens

xCrypt operates on a subscription or token-based model. Monthly plans come with preset token allocations; unused tokens may expire unless your plan includes rollover. Top-ups are available for additional usage.

5. Data Privacy

SkyL4rk complies with the Protection of Personal Information Act (POPIA) and the General Data Protection Regulation (GDPR). We do not sell your personal data. View our Privacy Policy for more details.

6. Security

We use industry-standard encryption, secure infrastructure, and access controls. While we take precautions, no system is 100% secure. You are also responsible for securing your environment.

7. Fair Use & Abuse

Fair usage policies apply to unlimited or high-volume plans. Abusive, excessive, or automated use outside intended scope may result in account suspension or throttling.

8. Termination

We reserve the right to terminate access if you breach these Terms, attempt to subvert licensing controls, or abuse API access. You may cancel at any time via your dashboard.

9. Intellectual Property

xCrypt and all branding, code, UI, and platform logic are the intellectual property of SkyL4rk (Pty) Ltd. You may not reverse-engineer or reproduce platform components without prior consent.

10. Changes to These Terms

We may update these Terms at any time. Significant changes will be notified by email or on your dashboard. Continued use after updates constitutes acceptance.

11. Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Disputes will be settled in the appropriate court jurisdiction of KwaZulu-Natal.
